BY ACCESSING OR USING THE WEBSITE, YOU, THE USER OF THIS WEBSITE, AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. 1. ABOUT UKURE

UKure is an online platform customised for cancer patients and their caregivers to search, compare and book cancer specialists and supportive services (together, "Specialist"). Our services are free to browse and open to all. However, registration is necessary if you want to book an appointment (face-to-face or online through voice call/ video call) with a Specialist through the Website.

In order to successfully use the Website, you must be at least 18 years of age and must complete the registration process by submitting your first name, last name, email address and telephone number (optional, in case you wish to receive reminders and confirmation for the appointment via text). Please ensure that the email address and phone number provided by you during registration is active and available for receiving emails and/or texts from UKure. You must not use any other person's account to access the Website. You must not allow any other person to use your account to access the Website. You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your Account. You agree to notify us immediately of any unauthorised use, or suspected unauthorised use of your account or any other breach of security. UKure cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

2. FEES AND PAYMENT

The UKure Website is free to join, browse, and book appointment for users and will always remain so. Booking an appointment with a Specialist through the Website is chargeable by Specialist directly as per the Specialist’s current rate for consultation. Consultation Fees are set up independently by the Specialists and may widely vary depending upon the particular Specialists’ experience, specialisation, geographical location, insurance providers and other factors. Additionally, Specialists listed on the Website with whom you may book appointments or consultations, may pay UKure a fee in order to be marketed through the Website. Users do not have the choice of making payment directly on the Website. UKure does not store any financial information and/or credit card details from any user and accepts no liability for any error in payment between users and Specialist under any circumstances whatsoever.

CANCELLATIONS AND REFUNDS

If a user needs or wishes to change or cancel the booking (time/date) after he/she has received the confirmation email, he/she may change or cancel the booking directly on the Website. If the user cancels a booking before the appointment, or does not show up at the scheduled appointment, there may be a cancellation fee charged by the Specialist, the amount of which is variable / fixed by the individual Specialists. UKure does not accept any responsibility or liability to any party for any cancellations or no-shows between users and Specialist under any manner whatsoever.

Please note all information provided in the Website is for general information purpose only. UKure bears no responsibility and is in no way liable for the (a) the availability or non-availability of the chosen Specialist, (b) the willingness or ability of any Specialist to give advice, (c) whether the user shall find a Specialist's advice relevant, useful, accurate or satisfactory, (d) whether the advice of the Specialist will be responsive or relevant to the user's question, or (e) whether the Specialist's advice will otherwise be suitable to the user's needs. While UKure will strive to provide accurate and updated credentials and qualifications of each listed Specialist on Website, it is highly recommended that the user independently verify the skills, degrees, qualifications, credentials and background of each Specialist from whom he or she receives or contemplates to receive advice or services. UKure does not take responsibility for verifying the skills, degrees, qualifications, credentials or background of any Specialists.

3. ACCEPTABLE USE OF WEBSITE

In order to maximise your user experience in using the Website, and avoid, eliminate or minimise disruptive activities, we kindly ask you to maintain the following:

  1. do not use the Website in any way or take any action that may undermine, disrupt, damage or manipulate the working functionality, performance, availability or accessibility of the Website;
  2. do not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of the Website, or any updates or any part thereof;
  3. do not use the Website in any manner that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
  4. do not impersonate any person or entity, misrepresent any affiliation with another person, entity, or association, use false IP addresses or headers, or otherwise conceal your identity for any purpose;

4. FEEDBACK AND REVIEWS

Users are welcome to submit honest feedback, ratings, reviews and comments about the specialist that they had booked through UKure and completed consultation. UKure does not screen, edit, publish or review such feedback prior to their appearance on the Website and they do not reflect any official statement, view or opinion of UKure in any manner whatsoever. However, UKure reserves the right to monitor all feedback and to remove any feedback which it considers in its absolute discretion to be inappropriate, offensive, defamatory or otherwise in breach of these Terms and Conditions.

UKure further disclaims any liability regarding any claim, complaint or grievance brought against any Specialist whose advice or services you had sought through the Website, unless it is regarding a prima facie breach of any of the Terms and Conditions mentioned herein. In case of the latter, you are requested to get in touch with our Customer Care team via the email mentioned below and lodge a written complaint no later than 14 days from the date of the incidence. Please note although we will make all efforts to resolve the issue to the best of your satisfaction, we cannot guarantee that the exact nature or method of resolution will be as per your request.

5. SUSPENSION OF SERVICE

UKure reserves the right to suspend or cease providing any services relating to the Website, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.

6. THIRD PARTY LINKS AND ADVERTISEMENTS

UKure may occasionally provide external links and advertisements submitted by or directed towards third party websites and services, including but not limited to social media platforms like Facebook, Instagram and LinkedIn. Unless expressly stated otherwise, such advertisements do not signify that UKure endorses and/or is associated with such third-party websites and services in any manner including, but not limited to, the content, accuracy, quality, nature, appropriateness, decency, functionality, performance, reliability, completeness, timeliness, validity, safety, legality or any other aspect thereof. We accept no responsibility for third party advertisements contained within the Website. If you agree to purchase goods and/or services from any third party who advertises in this Website, you do so at your own risk and these Terms and Conditions remains no longer applicable.

By using the UKure Website, you hereby acknowledge and agree that such usage is at your sole risk and responsibility. To the maximum extent permitted by applicable law, UKure is provided on an "as is" and "as available" basis without warranties of any kind, either expressed or implied, including, but not limited to, all warranties of quality, accuracy, completeness, reliability, conditions of merchantability, fitness for a particular purpose, title or non-infringement. UKure does not warrant that the products and services offered through the Website will meet your specific requirements, that the Website will be uninterrupted or error-free, that the Website will be free from viruses or similar harmful matter or that any defects in the Website will be immediately corrected. No oral or written communication offered by UKure will create any warranty for this purpose.

Under no circumstances will UKure any of its directors, shareholders, employees and agents be liable for any incidental, consequential, or indirect damages including, but not limited to, business interruption, damages for loss of profit, loss of data, loss of goodwill and the like arising out of the use or inability of use of the service/ information provided on or downloaded from the Website, or any delay in the processing of such information or services. For removal of doubt, this includes situations where there is any failure or delay in performance of any of the obligations under these Terms and Conditions that is caused by events outside our reasonable control (force majeure events). Notwithstanding the above, nothing under these Terms and Conditions will limit or exclude any liabilities that may not be excluded under applicable law.

You agree to indemnify, defend and hold harmless UKure, its officers, directors, employees, agents, licensors, consultants, representatives and agents from and against all losses, damages, suits, judgments, costs and expenses (including litigation costs and reasonable attorneys' fees) arising out of or in connection with (a) your use of or inability to use the Website (b) your violation of any provision of these Terms and Conditions or your violation of any rights of a third party, or (c) your violation of any applicable laws, rules or regulations. UKure reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will offer complete cooperation with UKure in asserting any available defenses.

All information and content displayed in the Website including text, graphics, designs, photographs, videos, typefaces, look and feel, format, and the like is owned and/or licensed by UKure unless expressly specified otherwise, and are protected by international laws on patents, copyrights, trade secrets, trade names, trademarks (whether registered or unregistered), domain names and other applicable rights. By agreeing to these Terms and Conditions you understand and agree to not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, any material on or from the Website, including text, graphics, logos and designs for any purpose whatsoever or allow any third party to do so. Upon presentation of suitable proof, UKure will act as required or appropriate under applicable law, including deleting any such content or link to the infringing material.

For contractual purposes, you (a) consent to receive communications from UKure in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that UKure provides to you electronically satisfy any legal requirement that such communications would satisfy if it were be in a hardcopy writing. With your informed consent (opt-in), such electronic communication may also include periodic emails and/or other messages for our internal marketing and promotional purposes. We take all reasonable measures to ensure that our marketing communications are compliant with the applicable laws including GDPR.

11. GENERAL INFORMATION

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. All disputes as to the validity, execution, performance, interpretation or termination of this Agreement will be submitted to the exclusive jurisdiction of Courts in London. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, such invalidity will not affect the enforceability of any other part or provision of this Agreement.

UKure reserves the right, at their sole discretion, to modify these Terms and Conditions at any time, and such modifications shall be effective immediately upon posting of the same on the Website. You agree to review this document periodically to be aware of such modifications and your continued access or use of the Website shall be deemed as a conclusive acceptance of such modified Terms and Conditions.
